BioBoost offers subscription plans that provide access to premium features. Subscription terms, pricing, and features are described in the Application and may change from time to time.
All purchases and subscriptions are processed through third-party platforms:
These platforms' terms of service govern payment processing, billing, renewals, and refunds. By subscribing through these platforms, you agree to their terms.
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the current period ends. Your payment method will be charged for renewal within 24 hours prior to the end of the current period.
You may cancel your subscription at any time through your Apple App Store account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the paid period.
Refund policies are determined by the Apple App Store. Generally, all sales are final, but you may request a refund directly through the platform according to their policies.
We reserve the right to modify subscription prices. Price changes will be communicated to you in advance and will take effect at the start of your next billing cycle. Your continued use of the Service after a price change constitutes acceptance of the new price.
We may offer free trial periods for premium subscriptions. If you do not cancel before the trial period ends, you will automatically be charged for the subscription. Trial eligibility is determined by us and may be limited to new users or specific promotional periods.
BioBoost integrates with Apple HealthKit to access your health and biometric data. By authorizing this integration, you agree that:

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, some of the above exclusions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BIOBOOST LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY:
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT NOT PROHIBITED BY LAW, THE COMPANY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF:
The limitations in this section reflect the allocation of risk between you and the Company. The limitations will apply even if any limited remedy fails of its essential purpose. These limitations are fundamental elements of the agreement between you and the Company.

If we cannot resolve the dispute informally within 60 days, any dispute arising from these Terms or the Service will be resolved through binding arbitration, rather than in court, except that:
Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and, where appropriate, the AAA's Supplementary Procedures for Consumer Related Disputes.

Unless both you and the Company agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.
You have the right to opt out of this arbitration provision by sending written notice to contact@trybioboost.app within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of this arbitration agreement.
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions.
To the extent arbitration does not apply, you agree to submit to the personal jurisdiction of the state and federal courts located in Maricopa County, Arizona.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be made enforceable, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BioBoost LLC regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice. Any attempted assignment in violation of this section shall be void.
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice before any new terms take effect.
